IN NO EVENT SHALL GIORDANOS'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO GIORDANOS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations of liability set forth above are fundamental elements of the basis of the bargain between Giordanos and you. Some jurisdictions do not allow limitations on liability for certain types of damages, so some limitations above may not apply to you.

We will use good-faith efforts to resolve the issue within thirty (30) days of receiving your written notice. This informal resolution step is a prerequisite to any formal dispute process.

15.2 Binding Arbitration

If a dispute cannot be resolved informally within thirty (30) days, you and Giordanos agree to resolve any dispute, claim, or controversy (collectively, "Disputes") arising out of or in connection with these Terms or the Services through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org.

The arbitration shall be conducted in English, and the arbitrator's award shall be final and binding, subject to limited judicial review under the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
